1. Acceptance of Terms

By accessing or using DayByDay ("the App"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the App.

2. Description of Service

DayByDay is a personal health tracking application that allows you to log and visualize weight, GLP-1 medication doses, sleep data, exercise, body measurements, and lab results. The App provides trend analysis, predictions, and insights based on the data you enter.

3. Not Medical Advice

DayByDay is not a medical device and does not provide medical advice. The information displayed in the App, including but not limited to BMI calculations, BMR estimates, weight predictions, medication level estimates, and health insights, is for informational and self-tracking purposes only.

You should always consult with your healthcare provider before:

  • Making changes to your medication regimen
  • Starting or modifying a weight loss program
  • Interpreting any health metrics or trends shown in the App
  • Making health decisions based on data displayed in the App

The App is not a substitute for professional medical advice, diagnosis, or treatment. Never disregard professional medical advice or delay seeking it because of information you read in the App.

4. User Accounts

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activity that occurs under your account
  • Providing accurate information when creating your account
  • Notifying us immediately of any unauthorized use of your account

5. User Data & Accuracy

You are solely responsible for the accuracy and completeness of the data you enter into the App. The App performs calculations and generates insights based on the data you provide. Inaccurate input data will result in inaccurate outputs.

6. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose
  • Attempt to gain unauthorized access to the App or its systems
  • Interfere with or disrupt the App's infrastructure
  • Use automated means to access the App without our permission
  • Impersonate any person or entity

7. Intellectual Property

The App, including its design, features, and content, is owned by DayByDay. You may not copy, modify, distribute, or create derivative works of the App without our written consent.

8. Free Trial & Subscriptions

Free Trial

New accounts receive a 14-day free trial with full access to all features. No credit card is required to start a trial. The trial begins when you create your account.

Subscription Plans

After your trial ends, continued access to the App requires a paid subscription:

  • Monthly: $5.99 per month
  • Yearly: $59.99 per year (equivalent to $5.00/month)

Subscriptions are billed through Apple In-App Purchases. Subscription terms, renewal, and cancellation are governed by Apple's terms and managed through your Apple ID settings.

Automatic Account Deletion

If you do not subscribe after your 14-day trial ends, your account and all associated data will be automatically and permanently deleted 15 days after account creation. We strongly recommend exporting your data before your trial expires if you do not intend to subscribe. This deletion is irreversible.

9. Account Termination

You may delete your account at any time through the Settings page in the App or from the paywall screen. We reserve the right to suspend or terminate accounts that violate these Terms of Use. Upon deletion, all associated data is permanently removed from our servers.

10. Limitation of Liability

To the maximum extent permitted by law, DayByDay and its creators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of data
  • Health outcomes resulting from use of the App
  • Inaccuracies in calculations, predictions, or insights
  • Service interruptions or downtime

The App is provided "as is" and "as available" without warranties of any kind, either express or implied.

11. Disclaimer of Warranties

We do not warrant that:

  • The App will be available at all times without interruption
  • The App will be free from errors or defects
  • Any health calculations or predictions will be accurate
  • The App will meet your specific requirements

12. Changes to Terms

We may update these Terms of Use from time to time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the App after changes constitutes acceptance of the updated terms.

13. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

If you are located in the European Economic Area, the United Kingdom, or Switzerland, nothing in these Terms affects your rights under mandatory consumer protection laws in your country of residence. Any disputes arising from these Terms that involve EU/EEA/UK consumers shall be subject to the jurisdiction of the courts in your country of residence, in addition to any other court of competent jurisdiction.

14. Dispute Resolution

If you have a dispute with us regarding the App or these Terms, we encourage you to first contact us at support@mydaybyday.app so we can attempt to resolve the issue informally.

For users in the European Union: You may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

15. Data Processing

Our collection, use, and protection of your personal data is governed by our Privacy Policy, which forms part of these Terms. By accepting these Terms, you acknowledge that you have read and understood our Privacy Policy.
